Alaska Stat. § 34.03. § 34.03.345
Mediation and binding arbitration
Operative Text
(a) A landlord and a tenant may agree to mediate disputes between them as to an obligation of either of them arising out of the rental agreement. If the landlord and tenant agree to mediate disputes, they shall include the scope of the agreement within the executed rental agreement, incorporate a reference to that agreement within the rental agreement, or add the text of the agreement as a separate attachment to the rental agreement. (b) A landlord and a tenant may agree to binding arbitration of the disputes between them as to an obligation of either of them arising out of the rental agreement. If the landlord and tenant agree to binding arbitration, they shall include the scope of the agreement within the executed rental agreement, incorporate a reference to that agreement within the rental agreement, or add the text of the agreement as a separate attachment to the rental agreement.
Alaska Statutes § 34.03.345 establishes that landlords and tenants may voluntarily agree to resolve rental disputes through mediation or binding arbitration rather than through the courts. Either type of agreement must be documented in writing — either within the rental agreement itself, referenced within it, or attached to it as a separate document. The provision covers disputes about obligations that arise from the rental agreement, and both mediation and binding arbitration are treated as optional, mutually agreed-upon alternatives.
Plain English — not legal advice.
Under AS 34.03 § 34.03.345, property owners and managers who wish to use mediation or binding arbitration for dispute resolution generally ensure that any such agreement is clearly memorialized in writing as part of the lease process. Compliant operators either include the full scope of the dispute-resolution agreement in the executed rental agreement, incorporate a reference to it, or attach it as a separate document. Keeping this documentation clear and complete helps establish that both parties understood and agreed to the chosen dispute-resolution method.

AS 34.03 § 34.03.345 means that any agreement to mediate or arbitrate disputes with a landlord must be voluntary and documented in writing connected to the rental agreement — it cannot simply be an informal or verbal understanding. Tenants should be aware that a binding arbitration clause, if agreed to, may affect how and where disputes are resolved. If a tenant has questions about whether a dispute-resolution clause in their lease is properly formed or enforceable, tenant-rights organizations or a legal aid office can be useful resources for understanding available options.
