Plain English

Under 10 Ariz. Admin. Code § R10-2-101 et seq. § R10-2-119, a respondent in a complaint proceeding has up to ten days after receiving the notice and complaint to file a written answer. That answer must be signed and include a declaration affirming, under penalty of perjury, that its contents are true and correct. The provision establishes both the deadline and the formal requirements that make an answer valid in the proceeding.

For Property Managers

Property owners or managers who receive a complaint notice governed by 10 Ariz. Admin. Code § R10-2-101 et seq. § R10-2-119 generally act promptly to prepare a written response within the ten-day window. A compliant answer includes the respondent's signature and the required perjury declaration affirming the truthfulness of the response. Operators familiar with this rule typically track the date of receipt carefully, since the deadline runs from that date rather than from when the complaint was filed.

For Tenants

If a tenant is named as a respondent in a complaint proceeding, 10 Ariz. Admin. Code § R10-2-101 et seq. § R10-2-119 gives them up to ten days from receipt of the notice to submit a signed, sworn answer. Understanding this deadline and the required affirmation language is important for anyone navigating the process, and tenant-rights organizations can help explain what a proper answer should address. Failing to respond within the timeframe or omitting the required declaration could affect how the proceeding moves forward.
