Plain English

A.R.S. § 33-303 et seq. § 33-381 establishes a boundary between two bodies of Arizona landlord-tenant law. The chapter containing this provision applies broadly to landlord-tenant relationships, but it carves out an exception for rental arrangements involving dwelling units, which are instead governed by Arizona Title 33, Chapters 10 or 11. In practice, this means the rules that apply to a given rental relationship depend on whether the property qualifies as a 'dwelling unit' under Arizona law.

For Property Managers

Property owners and managers should be aware that A.R.S. § 33-303 et seq. § 33-381 determines which body of Arizona law governs their rental operations. Operators renting residential dwelling units generally look to Chapters 10 or 11 of Title 33 for their compliance obligations, rather than the chapter containing this limitation provision. Compliant operators typically identify the nature of their rental property at the outset to confirm which statutory framework applies to their leases and practices.

For Tenants

A.R.S. § 33-303 et seq. § 33-381 is relevant to understanding which set of Arizona landlord-tenant rules protects renters in a given situation. Tenants renting dwelling units are generally covered by Arizona Title 33, Chapters 10 or 11, rather than the broader chapter where this provision appears. Renters who are uncertain about which legal framework applies to their situation may find it helpful to consult a tenant-rights organization or legal aid resource familiar with Arizona housing law.
