Ariz. Rev. Stat. § 33-1413.03
Care givers
Operative Text
Pursuant to state and federal fair housing laws, a resident who has a disability as defined in section 41-1491 may have one or more persons occupy the resident's mobile home to provide necessary live-in health care, personal care or supportive services if the care or services are necessary to afford the resident with a disability an equal opportunity to use and enjoy the dwelling. The landlord shall not charge a fee for the persons rendering live-in health care, personal care or supportive services. The persons rendering live-in health care, personal care or supportive services have no rights of tenancy, and any agreement between the resident and the persons rendering live-in health care, personal care or supportive services does not modify any term or condition of the rental agreement between the landlord and tenant. The persons rendering live-in health care, personal care or supportive services shall comply with the rules and regulations of the mobile home park.
Under A.R.S. § 33-1413.03, a mobile home park resident who has a qualifying disability is permitted to have one or more live-in caregivers occupy the home to provide necessary health care, personal care, or supportive services, as long as those services are needed to give the resident an equal opportunity to use and enjoy the dwelling. The landlord is prohibited from charging any additional fee for the presence of these caregivers. Caregivers do not acquire tenancy rights through this arrangement, and any private agreement between the resident and caregiver cannot alter the terms of the existing rental agreement; caregivers are also required to follow the mobile home park's rules and regulations.
Plain English — not legal advice.
Under A.R.S. § 33-1413.03, compliant mobile home park operators recognize that residents with qualifying disabilities have the right to host live-in caregivers without being charged an additional fee for those individuals. Operators generally document that caregivers are subject to park rules and regulations, and they avoid treating the caregiver's presence as a modification to the underlying rental agreement or as the creation of a new tenancy. Because this provision intersects with both state and federal fair housing laws, operators typically consult legal counsel when evaluating requests related to live-in care arrangements.

A.R.S. § 33-1413.03 gives mobile home park residents with a qualifying disability the right to have live-in caregivers present without being charged an extra fee by the landlord, provided the care or services are necessary for equal enjoyment of the dwelling. If a landlord attempts to impose such a fee or deny this accommodation, a resident may have grounds to raise a fair housing violation, which can be pursued through the Arizona Attorney General's Civil Rights Division or the U.S. Department of Housing and Urban Development. Tenant-rights organizations and legal aid services can help residents understand what documentation or process may be involved in asserting rights under this provision.
