Ariz. Rev. Stat. § 33-1473
Selfhelp for minor defects
Operative Text
A. If the landlord fails to comply with section 33-1434, the tenant may recover damages for the breach under section 33-1471, subsection B, or may notify the landlord of his intention to correct the condition at the landlord's expense. After being notified by the tenant in writing, if the landlord fails to comply within twenty days or as promptly thereafter as conditions require in case of emergency, the tenant may cause the work to be done by a licensed contractor and, after submitting to the landlord an itemized statement and a waiver of lien, deduct from his rent the actual and reasonable cost of the work. B. A tenant may not repair at the landlord's expense if the condition was caused by the deliberate or negligent act or omission of the tenant, a member of his family or other person on the premises with his consent.
Under A.R.S. § 33-1473, when a landlord fails to maintain the property as required by A.R.S. § 33-1434 and does not remedy the problem within twenty days of written notice (or sooner in an emergency), the tenant is permitted to hire a licensed contractor to fix the issue and deduct the actual, reasonable cost from rent after providing the landlord an itemized statement and a waiver of lien. This 'repair-and-deduct' remedy is not available when the defect was caused by the deliberate or negligent act or omission of the tenant, a household member, or a guest. The provision gives tenants a self-help path for minor defects while placing clear limits on when that path applies.
Plain English — not legal advice.
Property owners and managers operating under A.R.S. § 33-1473 generally maintain habitability standards required by A.R.S. § 33-1434 and respond promptly to written tenant notices about deficiencies. Compliant operators typically address reported conditions within the twenty-day window—or more quickly when an emergency exists—so that the repair-and-deduct remedy never becomes available to the tenant. Keeping records of all written communications and completed repairs helps demonstrate timely compliance if a dispute arises over a rent deduction.

A.R.S. § 33-1473 gives tenants a statutory right to arrange repairs through a licensed contractor and deduct the actual, reasonable cost from rent when a landlord fails to meet habitability obligations under A.R.S. § 33-1434 after receiving written notice and the required waiting period has passed. To use this remedy, tenants must submit an itemized statement and a waiver of lien to the landlord before making the deduction, and the remedy is not available if the defect was caused by the tenant, a family member, or a guest. Tenants who have questions about whether their situation qualifies may find it helpful to contact a local tenant-rights organization or consult the Arizona Residential Landlord and Tenant Act resources available through the Arizona Department of Housing.
