Ariz. Rev. Stat. § 33-2144
Abandonment
Operative Text
A. If a tenant abandons a recreational vehicle on the space, the landlord shall notify the owner and lienholder of record of the recreational vehicle within fifteen days about the owner's or lienholder's liability for any costs incurred for the rental space including rent and utility costs due. Before notice is provided to the legal owner or lienholder, the landlord is entitled to a maximum of sixty days' rent. After notice is provided, the legal owner or lienholder is responsible for all costs. The recreational vehicle shall not be removed from the space without a signed statement from the landlord, owner or park manager that shows clearance for removal of the recreational vehicle, that all monies due have been paid in full or that the legal owner and landlord have agreed to allow removal. B. This section applies only to recreational vehicles as defined in section 33-2102, paragraph 18, subdivision (c).
Under A.R.S. § 33-2144, when a tenant abandons a recreational vehicle on a rented space, a specific notification and cost-responsibility process is triggered. The landlord must notify the vehicle's owner and any lienholder of record within fifteen days, and the landlord's pre-notice rent recovery is capped at sixty days. Once proper notice is given, the legal owner or lienholder becomes responsible for all ongoing costs, and the vehicle cannot be physically removed from the space without a signed clearance statement confirming that all owed amounts have been paid or that a removal agreement has been reached. This section applies only to the category of recreational vehicles defined under A.R.S. § 33-2102(18)(c).
Plain English — not legal advice.
Under A.R.S. § 33-2144, operators of recreational vehicle parks generally document the date of abandonment promptly and send written notification to both the registered owner and any lienholder of record within the fifteen-day window. Compliant operators keep records showing when notice was delivered, since the sixty-day rent cap applies only to the pre-notice period and full cost recovery shifts to the legal owner or lienholder after notice is provided. Before allowing any removal of the vehicle, park managers typically obtain a signed clearance statement confirming that all outstanding rent and utility costs have been paid or that a written removal agreement is in place.
General guidance for property managers — not legal advice for your specific situation. Consult an attorney for advice on your case.
A.R.S. § 33-2144 establishes rights and obligations that can affect a tenant who has left a recreational vehicle behind on a rented space, as well as any lienholder with a recorded interest in that vehicle. If a landlord fails to follow the required notification timeline or attempts to remove the vehicle without the required signed clearance statement, those procedural requirements may be relevant to any dispute over costs or the vehicle's disposition. Tenants or lienholders who believe the process outlined in § 33-2144 was not followed may wish to consult a tenant-rights organization or legal aid resource familiar with Arizona recreational vehicle park law.
