Ariz. Rev. Stat. § 41-1491.14
Discrimination in sale or rental
Operative Text
A. A person may not refuse to sell or rent after a bona fide offer has been made or refuse to negotiate for the sale or rental of or otherwise make unavailable or deny a dwelling to any person because of race, color, religion, sex, familial status or national origin. B. A person may not discriminate against any person in the terms, conditions or privileges of sale or rental of a dwelling, or in providing services or facilities in connection with the sale or rental, because of race, color, religion, sex, familial status or national origin. C. This section does not prohibit discrimination against a person because the person has been convicted under federal law or the law of any state of the illegal manufacture or distribution of a controlled substance.
Under A.R.S. § 41-1491 et seq. § 41-1491.14, Arizona law prohibits anyone involved in the sale or rental of housing from refusing to deal with a prospective buyer or renter, or from imposing different terms and conditions, on the basis of race, color, religion, sex, familial status, or national origin. The rule covers both the initial transaction—such as refusing a bona fide offer—and the ongoing terms, services, and facilities connected to a sale or rental. One explicit carve-out exists: the provision does not extend its protections to individuals who have been convicted under federal or state law for the illegal manufacture or distribution of a controlled substance.
Plain English — not legal advice.
Operators subject to A.R.S. § 41-1491 et seq. § 41-1491.14 generally maintain consistent written criteria for evaluating offers and applications, applying those criteria uniformly regardless of an applicant's race, color, religion, sex, familial status, or national origin. Compliant operators also ensure that lease terms, amenity access, and services are offered on the same basis to all residents within comparable unit types. Screening policies that account for convictions related to the illegal manufacture or distribution of controlled substances remain permissible under this provision, provided they are applied consistently and in accordance with other applicable law.

A.R.S. § 41-1491 et seq. § 41-1491.14 gives prospective and current tenants the right to be free from housing discrimination based on race, color, religion, sex, familial status, or national origin—both when seeking housing and throughout the rental relationship. Individuals who believe a landlord has violated this provision may consider filing a complaint with the Arizona Attorney General's Civil Rights Division or with the U.S. Department of Housing and Urban Development, which administers parallel federal fair housing protections. Tenant-rights organizations and legal aid offices can help explain available enforcement paths, including administrative complaints and civil remedies.
