Property management definitions
Operative Text
17 CAR § 220-1016. Property management definitions. (a) As used in this part: (1) “Audit trail” means a documented history of a financial transaction by which the transaction can be traced to its source; (2) “Occupant” means a person who rents a property on a nightly basis; (3) "Property manager" means a licensed property management broker, real estate principal broker, or designated executive broker who performs property management activities pursuant to Arkansas Code § 17-42-103(10); and (4) “Tenant” means a person who rents a property on other than a nightly basis. (b) This subpart does not apply to any residential property management program operated or regulated by a federal or state act or agency that includes specific recordkeeping requirements that the Arkansas Real Estate Commission determines are substantially equivalent to or greater than that required by this subpart.
Section 220-1016 establishes the working definitions used throughout Arkansas's property management regulations. It distinguishes between an 'occupant' (someone renting on a nightly basis, such as a short-term rental guest) and a 'tenant' (someone renting on any other basis), and it defines who qualifies as a 'property manager' under Arkansas law. The section also carves out an exemption for residential property management programs already governed by federal or state requirements that the Arkansas Real Estate Commission finds are substantially equivalent to or stricter than those in this subpart.
Plain English — not legal advice.
Property owners and managers operating in Arkansas should be aware that § 220-1016 sets the foundational vocabulary for the state's property management rules, including what distinguishes a 'tenant' from an 'occupant.' A licensed property management broker, real estate principal broker, or designated executive broker performing property management activities under Arkansas Code § 17-42-103(10) falls within the definition of 'property manager' and is subject to this subpart's requirements. Operators running programs already regulated by a federal or state agency with equivalent or stricter recordkeeping standards may qualify for the exemption described in § 220-1016(b), which is determined by the Arkansas Real Estate Commission.

Under § 220-1016, Arkansas regulations draw a clear line between a 'tenant'—someone renting on other than a nightly basis—and an 'occupant,' who rents on a nightly basis, and this distinction can affect which protections and rules apply to a rental arrangement. Knowing which category applies to a given rental relationship can be relevant when evaluating rights under the broader property management subpart. Tenants who have questions about how these definitions affect their situation may find it helpful to consult a tenant-rights organization or review resources provided by the Arkansas Real Estate Commission.
