Cal. Civ. Code § 24-34-506.5
Conciliation agreements.
Operative Text
(1) A conciliation agreement arising out of a conciliation shall be an agreement between the respondent and the charging party, and shall be subject to approval by the director. (2) A conciliation agreement may provide for binding arbitration of the dispute arising from the charge. Any such arbitration that results from a conciliation agreement may award appropriate relief, including monetary relief. (3) Each conciliation agreement shall be made public unless the charging party and respondent otherwise agree and the director determines that disclosure is not required to further the purposes of this section. (4) Whenever the director has reasonable cause to believe that a respondent has breached a conciliation agreement, the director shall refer the matter to the attorney general with a recommendation that a civil action be filed under section 24-34-505.5 for the enforcement of such agreement. (5) Repealed.
Under Colorado Revised Statutes § 24-34-506.5, when a housing discrimination complaint is resolved through conciliation, the resulting agreement is a binding contract between the complainant and the respondent that must be approved by the director of the relevant state agency. The agreement may include a provision for binding arbitration, which can result in monetary or other appropriate relief. Conciliation agreements are generally made public unless both parties agree to keep them private and the director finds that disclosure is unnecessary to serve the statute's purposes. If a respondent is found to have breached the agreement, the director is required to refer the matter to the Colorado Attorney General for potential civil enforcement action.
Plain English — not legal advice.
Property owners and managers who enter into a conciliation agreement under § 24-34-506.5 are generally expected to fully comply with every term of that agreement once it has been approved by the director. Compliant operators keep detailed records demonstrating their adherence to agreed-upon obligations, since a breach can trigger a referral to the Colorado Attorney General and a civil enforcement action under § 24-34-505.5. Operators who agree to arbitration as part of the conciliation process should be aware that any resulting arbitration award—including monetary relief—is binding.

Under § 24-34-506.5, a charging party who reaches a conciliation agreement has the protection of a director-approved, legally enforceable contract, and may also have agreed to binding arbitration that can result in monetary relief. If a respondent fails to honor the terms of the agreement, the statute requires the director to refer the matter to the Colorado Attorney General for civil enforcement—a path that does not require the charging party to initiate a new complaint independently. Tenants who believe a conciliation agreement has been violated may wish to contact the Colorado Civil Rights Division or consult a tenant-rights organization to understand what steps are available under this provision.
