Cal. Civ. Code § 38-12-1405
Recordkeeping.
Operative Text
(1) For any rent-to-own contract, the seller of the mobile home shall maintain separate financial records for each rent-to-own contract. (2) The seller of the mobile home shall provide the purchaser with either an annual accounting related to the rent-to-own contract or a disclosure that the buyer is entitled to request and receive an annual accounting of their rent-to-own contract. The accounting or the disclosure is due to the purchaser each year within ten days of the anniversary date of the rent-to-own contract. If requested, the annual accounting shall be provided within ten days upon the receipt of a request for accounting. At a minimum, any accounting provided shall disclose the total amount in purchase payments made, the total amount of the purchase price remaining to be paid, and any expenses paid by the seller during the accounting period to repair or maintain the mobile home. The accounting or the disclosure shall be provided to the purchaser in English or English and Spanish, as requested by the purchaser.
Colorado Revised Statutes § 38-12-1405 establishes recordkeeping and disclosure requirements for sellers who enter into rent-to-own contracts for mobile homes. Sellers must keep separate financial records for each such contract and must annually provide the buyer either a detailed accounting or a notice informing the buyer of their right to request one. When an accounting is provided or requested, it must include the total payments made, the remaining purchase price, and any repair or maintenance expenses the seller paid during the period. The accounting or disclosure must be delivered within ten days of the contract's anniversary date each year, or within ten days of a buyer's request, and must be furnished in English or both English and Spanish as the buyer prefers.
Plain English — not legal advice.
Under § 38-12-1405, operators who sell mobile homes through rent-to-own arrangements generally maintain a distinct set of financial records for every individual contract rather than commingling them. Each year, within ten days of the contract's anniversary, compliant sellers either deliver a full accounting—covering cumulative payments received, the outstanding purchase balance, and any seller-paid repair or maintenance costs—or a written notice advising the buyer of their right to request that accounting. Sellers also respond to any buyer-initiated accounting request within ten days of receipt and confirm the buyer's language preference so the document is provided in English or both English and Spanish as appropriate.

Section § 38-12-1405 gives mobile-home rent-to-own purchasers the right to receive either an annual accounting or a written notice of their right to request one, delivered within ten days of each contract anniversary. If a buyer requests an accounting, the seller must provide it within ten days, and it must detail total payments made, the remaining purchase price, and any repair or maintenance costs the seller covered. Buyers who believe a seller has not met these obligations may wish to consult a tenant-rights organization familiar with Colorado mobile-home law or explore whether a complaint can be raised through available state or local channels.
