Colorado Revised Statutes § 38-12-1502 requires landlords to follow specific federal notice procedures—those set out in 15 U.S.C. § 9058(c) as it existed on March 27, 2020—before starting an eviction case based on a tenant's failure to pay rent. This requirement applies regardless of any subsequent changes to federal law, effectively locking in the March 2020 version of those notice rules. The provision also encourages Colorado's Division of Housing to maintain a publicly available list of resources to help landlords identify covered properties and locate financial assistance.

For Property Managers

Under Colo. Rev. Stat. § 38-12-1502, operators who pursue eviction for nonpayment of rent are expected to deliver the notice prescribed by the March 27, 2020 version of 15 U.S.C. § 9058(c) before filing any eviction action. Compliant operators typically document that the required notice was provided and retain records of that delivery. Colorado's Division of Housing is also encouraged to publish a resource list on its website that can help landlords determine whether their properties qualify as 'covered dwellings' and identify available financial programs.

For Tenants

Colo. Rev. Stat. § 38-12-1502 gives tenants a basis to examine whether their landlord delivered the federally prescribed notice—as it stood on March 27, 2020—before initiating a nonpayment-of-rent eviction. If that notice was not properly provided, a tenant may be able to raise the omission as a defense in the eviction proceeding. Tenants who have questions about whether this requirement was met can consult a local tenant-rights organization or legal aid office for general information about their options.
