Under Colo. Rev. Stat. § 38-12-215, when a mobile home park or manufactured housing community is newly developed, its management is permitted to set a one-time condition on first-time site leases: that the incoming resident purchased their home from a specific seller or a designated group of sellers. Additionally, the management of such a new development may enter into a contract granting a licensed mobile home or manufactured home dealer the exclusive right to arrange first-time rentals of one or more sites. These allowances apply only to the initial leasing of a site and are specific to new developments.

For Property Managers

Operators of new mobile home parks or manufactured housing communities may, under Colo. Rev. Stat. § 38-12-215, structure first-time site leases to require that prospective residents have purchased their home from a designated seller or group of sellers. Management may also formalize an exclusive first-rental arrangement with a licensed dealer through a written contract. Compliant operators generally ensure these conditions are applied only at the initial leasing stage and only within a qualifying new development, not to subsequent re-rentals of the same site.

For Tenants

Colo. Rev. Stat. § 38-12-215 means that if you are considering renting a site in a newly developed mobile home park or manufactured housing community for the first time, the management may lawfully require that you have purchased your home from a particular seller or group of sellers as a condition of that lease. It is also possible that a licensed dealer holds an exclusive contractual right to arrange first-time rentals at that community. Prospective residents who have questions about whether these conditions are being applied appropriately beyond the first-time leasing context may wish to consult a tenant-rights organization or review Colorado's mobile home park statutes for further context.
