Cal. Civ. Code § 38-12-302
Definitions.
Operative Text
As used in this part 3, unless the context otherwise requires: (1) "Municipality" means a city or town and, in addition, means a city or town incorporated prior to July 3, 1877, whether or not reorganized, and any city, town, or city and county which has chosen to adopt a home rule charter pursuant to the provisions of article XX of the state constitution.
Colo. Rev. Stat. § 38-12-302 establishes the meaning of key terms used throughout Part 3 of Colorado's residential tenants' statutory protections. Specifically, it defines 'Municipality' broadly to include cities and towns of various incorporation dates and legal structures, as well as home-rule jurisdictions that have adopted charters under Article XX of the Colorado Constitution. This definitional provision shapes which local governments fall within the scope of Part 3's rules.

Property owners and managers operating in Colorado should be aware that Colo. Rev. Stat. § 38-12-302 sets the foundational definitions that determine which local governments are covered under Part 3 of the state's residential tenancy statutes. Because 'Municipality' is defined to include home-rule cities and towns—not just standard incorporated municipalities—operators in a wide range of Colorado communities may find Part 3's requirements applicable to their properties. Compliant operators generally familiarize themselves with whether their jurisdiction qualifies as a 'Municipality' under this definition before assessing their obligations under the broader Part 3 framework.
