1 Del. Admin. Code § 602 § 12.0
Decision and Orders
Operative Text
12.1 Deliberations of the Panel are non-public. The case decision may be rendered immediately following the Hearing or the Panel may reserve its decision to a later date and so advise the parties. Decisions shall be by majority vote of the Panel. 12.2 A copy of the Final Order shall be delivered by hand or mailed by Certified Mail, Return Receipt Requested, or by regular first class mail to the parties' last known address. In addition each party shall be notified of the right to seek reconsideration by the Panel. 12.3 Any party within ten (10) days after mailing of the Final order may apply to the Panel for reconsideration briefly and distinctly stating the grounds therefor. Such application for reconsider must show service on the opposing party. Within ten (10) days after service of such motion, the opposing party may serve and file a brief answer to each ground asserted in the motion. The Panel shall promptly convene to consider such motion for reconsideration. The filing of such application shall not extend the time for judicial review under Section 4612(i).
Under 1 Del. Admin. Code 602 § 12.0, a hearing panel deliberates privately and issues its decision either immediately after the hearing or at a later date, with the majority vote determining the outcome. The Final Order is delivered to the parties by hand, certified mail, or first-class mail, and each party is informed of their right to seek reconsideration. A party has ten days from mailing of the Final Order to request reconsideration, and the opposing party then has ten days to respond; importantly, filing for reconsideration does not pause or extend the deadline for seeking judicial review.

Property owners and managers subject to proceedings under 1 Del. Admin. Code 602 § 12.0 should ensure their current mailing address is on record with the panel, since the Final Order is sent to the last known address. Compliant operators generally track the mailing date of the Final Order carefully, as the ten-day window for requesting reconsideration begins at that point. Operators also typically note that pursuing reconsideration does not toll the separate deadline for judicial review under Section 4612(i).

Tenants involved in a panel proceeding under 1 Del. Admin. Code 602 § 12.0 have the right to receive a copy of the Final Order and to be notified of their right to seek reconsideration. If a tenant wishes to challenge the decision, a written reconsideration request must be filed within ten days of the order's mailing and must show that the opposing party was served. Because filing for reconsideration does not extend the time for judicial review under Section 4612(i), tenants may wish to consult a tenant-rights organization to understand how these parallel deadlines interact.
