Section 1.0 of 1 Del. Admin. Code 706 establishes the foundational scope and purpose of Delaware's residential smoke detector regulation, which supplements the requirements already found in 16 Del.C., Ch. 66. The rule applies broadly to virtually every type of residential setting in the state—whether owned, rented, or leased—including single-family homes, mobile homes, apartments, hotels, dormitories, and board and care facilities. Its reach covers both permanent residents and transient occupants, making it one of the widest-ranging provisions in Delaware's residential safety framework.

For Property Managers

Under 1 Del. Admin. Code 706 § 1.0, property owners and managers operating any form of residential occupancy in Delaware—from a single-family rental to a multi-unit apartment building or a bed and breakfast—fall within the scope of this smoke detector regulation. Compliant operators generally familiarize themselves with both this administrative code and the underlying statutory requirements in 16 Del.C., Ch. 66, since the regulation is explicitly designed to supplement that chapter. Keeping documentation of smoke detector installation and maintenance across all covered property types is a practice commonly associated with regulatory compliance.

For Tenants

Tenants living in virtually any residential setting in Delaware—apartments, rooming houses, mobile homes, dormitories, and more—are covered by the protections established under 1 Del. Admin. Code 706 § 1.0. This provision, read alongside 16 Del.C., Ch. 66, means that the obligation to meet smoke detector installation criteria extends to rented and leased properties, not just owner-occupied ones. Tenants who believe their residence does not meet applicable smoke detector requirements may consider contacting Delaware's relevant housing or fire safety authorities, or reaching out to a local tenant-rights organization for general guidance on available options.
