Section 5.0 of 1 Del. Admin. Code 706 establishes the dates by which different categories of residential properties were required to come into compliance with Delaware's smoke detector legislation. Newly built single-family homes, two-family dwellings, mobile homes, modular homes, and townhouses had to comply as of the legislation's effective date, while existing versions of those same property types had until July 1, 1994. For other residential occupancy types covered under §4.0, newly constructed buildings also had to comply by the legislation's effective date, while pre-existing buildings of those types had until July 1, 1996.

Under 1 Del. Admin. Code 706 § 5.0, compliant property owners and managers ensure that smoke detector requirements were met by the applicable compliance date for each property type they operate — the legislation's effective date for new construction and July 1, 1994 or July 1, 1996 (depending on property type) for existing structures. Operators of residential properties generally maintain documentation showing when smoke detectors were installed and that installations met the standards in effect at the time of the applicable compliance date. Ongoing maintenance and record-keeping practices help demonstrate continued adherence to the underlying requirements referenced in 16 Del.C. §6634.

Section 5.0 of 1 Del. Admin. Code 706 establishes that residential properties — including single-family homes, mobile homes, and other covered occupancies — were required to have compliant smoke detectors installed by specific dates, with existing dwellings required to comply no later than July 1, 1994 or July 1, 1996 depending on property type. Tenants who believe their residence lacks required smoke detectors may have grounds to raise this as a habitability concern, file a complaint with a relevant local or state housing authority, or consult a tenant-rights organization familiar with Delaware law. Understanding the compliance timeline under 16 Del.C. §6634 can help tenants assess whether their housing meets the baseline safety standards established by this regulation.
