16 Del. C. ch. 66C § 6602C
Carbon monoxide detection devices required
Operative Text
(a) Each owner of a lodging establishment shall install carbon monoxide detection devices in accordance with the installation requirements in § 6603C of this title if a dwelling unit or sleeping unit has either of the following: (1) A fossil-fuel burning heater or appliance, a fireplace, or other feature, fixture, or element that emits carbon monoxide as a byproduct of combustion. (2) An attached garage. (b) The requirement of carbon monoxide detection devices under subsection (a) of this section applies to all new and existing lodging establishments, in accordance with the compliance dates provided in § 6604C of this title, regardless of when any such lodging establishment was built. (c) The owner of a lodging establishment must install and maintain carbon monoxide detection devices required under this chapter, unless there is a tenant of a rented or leased lodging establishment required to have carbon monoxide detection devices under this chapter and the rental agreement, lease agreement, or contract is for a period of 1 month or more. In such a case, the owner must install the required carbon monoxide detection devices but the tenant is responsible for maintaining an operable battery in any carbon monoxide detection devices within the individual rented or leased dwelling unit.
Under 16 Del. C. ch. 66C § 6602C, owners of lodging establishments are required to install carbon monoxide detection devices in any dwelling or sleeping unit that contains a fossil-fuel burning heater or appliance, a fireplace, or similar combustion-emitting feature, or that has an attached garage. This requirement applies to both new and existing lodging establishments, regardless of when they were constructed, with compliance dates set out elsewhere in the chapter. When a unit is rented or leased under an agreement of one month or more, the owner must still install the devices, but the tenant takes on responsibility for keeping an operable battery in any detection device within their individual unit.

Under 16 Del. C. ch. 66C § 6602C, compliant lodging establishment owners generally ensure that carbon monoxide detection devices are installed in every qualifying unit — those with combustion-emitting appliances, fireplaces, or attached garages — following the installation standards referenced in the chapter. Owners bear the installation obligation regardless of whether the property is new or existing, and regardless of its construction date. When a unit is rented under a lease or rental agreement of one month or more, operators typically document in the agreement that the tenant is responsible for maintaining an operable battery in the detection devices within their individual unit.

Under 16 Del. C. ch. 66C § 6602C, tenants in lodging establishments with qualifying features — such as gas appliances, fireplaces, or attached garages — have the right to have carbon monoxide detection devices installed by their owner or landlord. If a rental or lease agreement runs for one month or more, the tenant is responsible for keeping an operable battery in any carbon monoxide detection device within their individual unit, while the installation obligation remains with the owner. Tenants who believe this provision is not being met may consider contacting a local housing authority, raising the issue as a potential lease violation, or reaching out to a tenant-rights organization for general information about available options.
