25 Del. C. ch. 70 § 7001
Purposes and policies; enforceability
Operative Text
(a) Subchapters I through V of this chapter must be liberally construed and applied to promote the following underlying purposes and policies: (1) To clarify and establish the law governing the rental of lots for manufactured homes as well as the rights and obligations of manufactured home community owners (landlords), manufactured homeowners (tenants), and residents of manufactured home communities. (2) To encourage manufactured home community owners and manufactured homeowners, and residents to maintain and improve the quality of life in manufactured home communities. (b) Subchapters I through V of this chapter apply to all rental agreements for manufactured home lots and regulates and determines the legal rights, remedies, and obligations of all parties to a rental agreement, wherever executed, for a lot for a manufactured home in a manufactured home community within this State. A provision of a rental agreement which conflicts with a provision of subchapters I through V of this chapter and is not expressly authorized herein is unenforceable. The unenforceability of a provision does not affect the enforceability of other provisions of a rental agreement which can be given effect without the unenforceable provision.
Section 7001 of Delaware's Manufactured Home Landlord-Tenant Code (25 Del. C. ch. 70) establishes the foundational purposes and scope of the law governing lot rentals in manufactured home communities. The law applies to all rental agreements for manufactured home lots within Delaware, regardless of where those agreements were signed. Any lease clause that conflicts with the statute's requirements is unenforceable, though the rest of the agreement remains intact and valid.
Plain English — not legal advice.
Under § 7001, operators of Delaware manufactured home communities are subject to Subchapters I through V of Chapter 70 for every lot rental agreement, even if the lease was signed outside the state. Compliant community owners generally review their lease terms to ensure no clause contradicts the statutory framework, since conflicting provisions will be deemed unenforceable. The statute is designed to be interpreted broadly, so lease language that attempts to limit tenant rights beyond what the chapter expressly permits is at risk of being set aside.

Section 7001 establishes that Delaware's manufactured home community law applies to your lot rental agreement and is meant to be interpreted in a way that promotes residents' rights and quality of life. If a lease clause conflicts with Subchapters I through V of Chapter 70, that clause is unenforceable under § 7001, and tenants may raise that unenforceability as a defense in a dispute. Residents who believe a lease provision violates the chapter may wish to consult a tenant-rights organization or legal aid service familiar with Delaware manufactured home community law for general information about available options.
