25 Del. C. ch. 70 § 7012
Effect of unsigned rental agreement
Operative Text
(a) If the landlord does not sign a written rental agreement which has been signed and tendered to the landlord by the tenant, acceptance of rent from the tenant without reservation by the landlord gives to the rental agreement the same effect as if it had been signed by the landlord. (b) If the tenant does not sign a rental agreement which has been signed and tendered to the tenant by the landlord, acceptance of possession of the rented lot and payment of rent without reservation give to the rental agreement the same effect as if it had been signed by the tenant. (c) Even if a rental agreement which is given effect by the operation of this section provides for a term longer than 1 year, it operates to create only a 1-year term.
Under 25 Del. C. ch. 70 § 7012, a written rental agreement can become legally binding even without a signature from one of the parties. If a landlord accepts rent without reservation after receiving a tenant-signed agreement, the agreement is treated as though the landlord signed it. Conversely, if a tenant takes possession and pays rent without reservation after receiving a landlord-signed agreement, the agreement is treated as though the tenant signed it. Regardless of any longer term stated in the agreement, a contract made binding this way creates only a one-year tenancy.
Plain English — not legal advice.
Property owners and managers operating under 25 Del. C. ch. 70 § 7012 should be aware that accepting rent payments without reservation can make an unsigned written agreement fully enforceable against them. Compliant operators typically review and formally execute rental agreements before accepting any payment, and they document any reservations or objections if a payment is accepted while a dispute over the agreement's terms remains unresolved. Because this provision caps any resulting tenancy at one year regardless of what a longer-term agreement states, operators generally confirm that all parties have signed before relying on lease terms that extend beyond that period.

Under 25 Del. C. ch. 70 § 7012, tenants have a basis to argue that a written rental agreement is enforceable even if the landlord never formally signed it, provided the landlord accepted rent without reservation. This means the terms of that written agreement — such as rent amount or rules about the property — may still apply to both parties. Tenants who believe a landlord is acting inconsistently with an agreement made binding under this provision may consider raising the provision as a defense in any dispute, contacting a local tenant-rights organization for general information, or consulting with a housing attorney about their options.
