25 Del. C. ch. 71 § 7106
Approval by Attorney General
Operative Text
No conversion of real property on which a manufactured home community is situated shall be lawful unless such conversion has received the approval of the Attorney General after a thorough review the conversion plan to determine compliance with this chapter. Where the Attorney General has not acted to approve, conditionally approve or disapprove a conversion plan or prospective conversion within 90 days after receipt of the conversion plan, the conversion plan or prospective conversion shall be deemed to have been approved; provided, however, that the provisions of § 7103 of this title are mandatory, and cannot be waived. The Attorney General may, by a writing addressed to the owner, suspend the Attorney General’s decision for an additional 30 days. When the conversion plan is approved, no provision of the plan shall be changed without the written approval of the Attorney General.
Under 25 Del. C. ch. 71 § 7106, any conversion of land on which a manufactured home community sits is unlawful unless the Delaware Attorney General reviews the conversion plan and finds it compliant with the chapter's requirements. If the Attorney General does not act—by approving, conditionally approving, or disapproving—within 90 days of receiving the plan, the plan is automatically deemed approved, though certain mandatory protections under § 7103 can never be waived. Once a plan is approved, any changes to it require the Attorney General's written consent, and the Attorney General may also extend the review window by an additional 30 days through written notice to the owner.

Operators of manufactured home communities in Delaware who are considering a conversion must submit a complete conversion plan to the Attorney General for review under 25 Del. C. ch. 71 § 7106 before any conversion can lawfully proceed. Compliant operators track the 90-day review clock carefully, understand that the protections in § 7103 remain in force regardless of any approval, and obtain written Attorney General approval before making any modifications to an already-approved plan. Maintaining thorough documentation of submission dates and all written communications with the Attorney General's office is a standard practice for operators navigating this process.

Section 7106 of 25 Del. C. ch. 71 provides residents of manufactured home communities with a meaningful procedural safeguard: a conversion of the community's land cannot legally move forward without Attorney General review and approval of the conversion plan. Importantly, the mandatory protections established under § 7103 cannot be waived even if a plan is deemed approved by default, meaning residents retain those rights regardless of how the approval process concludes. Tenants who believe a conversion is proceeding without proper Attorney General approval, or that § 7103 protections are being ignored, may consider contacting the Delaware Attorney General's office directly, reaching out to a tenant-rights organization, or consulting an attorney familiar with manufactured housing law.
