25 Del. C. ch. 71 § 7111
Tenants who are elderly or have disabilities
Operative Text
In addition to the protection provided to tenants under this chapter, the following provisions shall apply on behalf of any tenant who has a disability or who is 65 years of age or older: (1) The owner shall supply a list of at least 3 comparable rental units, including manufactured home communities, which have vacancies and which can accommodate such person if such exists, subject, however, to the terms of § 7112(c) of this title; (2) The owner shall supply the address and telephone number of the nearest municipal, state or federal agency which can provide information and assistance to such tenant under the National Housing Act [12 U.S.C. § 1701 et seq.] and the Uniform Relocation Assistance Act [§ 9301 et seq. of Title 29]; (3) Where the tenant remains on the premises at the expiration of the 3-year period, and has in good faith attempted to obtain adequate housing, such tenant shall be permitted to stay on the premises until permanent housing is obtained. Any increase in rent shall be in conformity with the terms of § 7110(d) of this title.
Under 25 Del. C. ch. 71 § 7111, Delaware law provides additional protections for tenants who are 65 or older or who have a disability, beyond the standard protections in Chapter 71. When such a tenant faces displacement, the property owner is required to furnish a list of at least three comparable available rental units that can accommodate the tenant, as well as contact information for the nearest housing assistance agency under federal relocation and housing programs. If the tenant has made a good-faith effort to find permanent housing and remains on the premises after a three-year period, the law allows that tenant to stay until permanent housing is secured, with any rent increases governed by the limits set out in § 7110(d).
Plain English — not legal advice.
Property owners subject to 25 Del. C. ch. 71 § 7111 generally maintain awareness of comparable available rental units—including manufactured home communities—that can accommodate tenants with disabilities or those aged 65 and older, so that a list of at least three such units can be provided when required. Compliant operators also keep on hand the address and telephone number of the nearest municipal, state, or federal agency offering housing assistance under the National Housing Act and the Uniform Relocation Assistance Act. When a qualifying tenant remains on the premises after the three-year period and has made a good-faith effort to find housing, operators apply rent increases only in accordance with § 7110(d) of this title.
General guidance for property managers — not legal advice for your specific situation. Consult an attorney for advice on your case.
Section 7111 of Title 25 of the Delaware Code gives tenants who are 65 or older or who have a disability specific rights beyond those available to other tenants under Chapter 71. If you fall into one of these categories, your landlord is generally required to provide you with a list of at least three comparable available rental units and the contact information for a nearby agency that can offer housing assistance under federal law. If you have genuinely tried to find permanent housing and are still on the premises after three years, the law permits you to remain until you secure permanent housing; tenants in this situation may wish to contact a tenant-rights organization or a local housing agency to understand how § 7110(d) rent-increase limits apply to their circumstances.
