Property owners and managers operating under 31 Del. C. ch. 41 § 4114 generally maintain a routine inspection schedule covering structural members, interior surfaces, bathroom and kitchen floors, and all exit facilities including stairs and railings. Compliant operators promptly address signs of deterioration, dampness in below-grade spaces, pest activity, and any accumulation of refuse in common areas such as hallways and stairwells. Operators also ensure that no lead-based paint exceeding 0.5 percent lead content is applied to any surface of the dwelling, and that extermination efforts following any infestation are accompanied by preventive measures against reinfestation.

Under 31 Del. C. ch. 41 § 4114, tenants have the right to occupy a dwelling whose interior structure, surfaces, exits, and common areas are maintained in a safe, clean, and sanitary condition. If conditions such as pest infestations, standing water in basements, deteriorating stairs or railings, blocked exits, or refuse accumulation are present, tenants may document these issues and report them to the relevant local housing or code enforcement authority in Delaware. Tenant-rights organizations can help residents understand available options, which may include filing a formal complaint or raising a housing code violation as a defense in certain legal proceedings.
