Operative Text

31 Del. C. ch. 41 § 4122
This subchapter shall govern the administration and enforcement procedures of the State Housing Code. Any municipality or county that adopts the Code as its own may use these administrative and enforcement procedures as its own or may develop procedures which are similar in nature as determined by the Code official.

Plain English

Section 4122 of Title 31 of the Delaware Code establishes that the administrative and enforcement procedures set out in this subchapter apply to the State Housing Code. Local governments—municipalities and counties—that formally adopt the State Housing Code may either follow these same procedures or create their own procedures that are comparable in nature, as determined by the relevant Code official. This provision essentially sets the framework for how housing code rules are carried out and enforced across Delaware.

For Property Managers

Under 31 Del. C. ch. 41 § 4122, property owners operating in Delaware should be aware that the enforcement procedures governing their compliance obligations may come from the State Housing Code's subchapter or from locally developed procedures adopted by their municipality or county. Compliant operators typically familiarize themselves with whether their local jurisdiction has adopted the State Housing Code directly or has established its own comparable procedures. Knowing which set of procedures applies in a given locality helps operators understand inspection processes, violation notices, and correction timelines.

For Tenants

Section 4122 of Title 31 of the Delaware Code means that the rules governing how housing code violations are identified, reported, and enforced may vary depending on whether a tenant's municipality or county has adopted the State Housing Code's procedures or developed its own comparable framework. Tenants who believe their housing conditions violate applicable standards can start by contacting their local Code official to learn which enforcement procedures apply in their area. Tenant-rights organizations can also help residents understand the specific administrative process available to them under either the state or local framework.
