6 Del. C. ch. 46 § 4609
Education and conciliation
Operative Text
(a) The Commission may commence such educational activities as, in its judgment, will further the purposes of this chapter. It may hold conferences for persons in the business industry and other interested parties to acquaint them with the provisions of this chapter and its suggested means of implementing it. The Commission may issue reports on such conferences as it deems appropriate. (b) The Division may commence such conciliatory activities in order to further the purposes of this chapter. It may call conferences of persons in the business industry and other interested parties to acquaint them with the provisions of this chapter governing conciliation and the means it employs to implement those provisions. It shall endeavor, with their advice, to develop programs of voluntary compliance and enforcement. The Division may issue reports on such conferences as it deems appropriate. (c) When undertaking their respective duties under this section, the Commission and the Division may consult with state and local officials and other interested parties to learn the extent, if any, to which discriminatory public accommodations practices exist in the State or locality, and whether and how state or local enforcement programs might be utilized to combat such discrimination. The Commission may issue reports on such consultations as it deems appropriate.
Section 4609 of Title 6 of the Delaware Code authorizes two state bodies — the Commission and the Division — to carry out educational and conciliatory work aimed at reducing discriminatory public accommodations practices. The Commission may organize conferences, issue reports, and consult with state and local officials to understand the scope of discrimination in the state. The Division, separately, may convene conferences and work with industry participants and other stakeholders to develop voluntary compliance and enforcement programs.

Under 6 Del. C. ch. 46 § 4609, property owners and managers in the public accommodations sector may be invited to participate in Commission- or Division-sponsored conferences designed to explain the chapter's anti-discrimination requirements and how they are implemented. Operators who engage with these educational and conciliatory processes are generally better positioned to understand what voluntary compliance looks like under this chapter. Staying informed about reports and programs issued under § 4609 is a common practice among operators seeking to align their policies with the chapter's purposes.

Section 4609 of Delaware's public accommodations law establishes that the Commission and the Division have affirmative authority to educate the public and pursue conciliation — tools that can benefit individuals who believe they have experienced discriminatory treatment. The Division's conciliation activities under this provision represent one avenue through which disputes may be addressed outside of formal adjudication. Tenants and consumers who believe their rights under this chapter have been violated may wish to contact the Division to learn about available conciliatory processes or consult a tenant-rights or civil rights organization for general guidance.
