The Mayor shall establish the fees by rulemaking pursuant to subchapter I of Chapter 5 of Title 2 [ § 2-501 et seq.]. (b) Each application for approval of a conversion shall be accompanied by payment to cover the fees, if any, prescribed pursuant to this section. D.C. Code § 42-3402.05a authorizes the Mayor of the District of Columbia to establish and collect fees for processing condominium or cooperative conversion applications and related services provided by the Department of Housing and Community Development. These fees must be set through a formal rulemaking process, and any money collected is deposited into the Department of Housing and Community Development Unified Fund rather than a general revenue account. Every conversion application must include payment of whatever fees have been established under this provision at the time of submission.

Property owners or managers seeking to convert a rental building to condominium or cooperative ownership in the District of Columbia should be aware that D.C. Code § 42-3402.05a requires each conversion application to be accompanied by the applicable processing fee at the time of filing. Compliant operators typically verify the current fee schedule—set by the Mayor through rulemaking—before submitting an application to the Department of Housing and Community Development. Keeping documentation of fee payments is a standard practice, as the accompanying payment is a condition of a complete application.

D.C. Code § 42-3402.05a is relevant to tenants living in buildings where a landlord is seeking to convert the property to condominium or cooperative ownership, because the conversion approval process involves fees paid to the Department of Housing and Community Development. Tenants can monitor whether a conversion application has been properly filed and accompanied by required fees, which is a procedural requirement of the approval process. Tenant-rights organizations in the District of Columbia can help residents understand how the conversion application process works and what rights tenants hold during that process.
