Revocation.
Operative Text
(a) A certificate issued pursuant to § 42-3402.02(a) , an exemption issued pursuant to § 42-3402.02(b) or § 42-3402.10 , or registration required pursuant to § 42-3404.11 may be revoked after notice and hearing upon a written finding of fact that the holder of the certificate, the holder of the exemption, or the registrant has: (1) Failed to comply with the terms of a cease and desist order; (2) Failed faithfully to perform any stipulation or agreement made with the Mayor as an inducement to grant any certificate, exemption, or registration; or (3) Made intentional misrepresentations or concealed material facts in an application for a certificate, exemption, or registration. (b) If the Mayor finds after notice and hearing that the holder of a certificate, the holder of an exemption, or the registrant has been guilty of a violation for which revocation could be ordered, the Mayor may issue a cease and desist order; or, upon adjudication for any infraction thereof, impose civil fines, penalties, and fees as alternative sanctions, pursuant to Chapter 18 of Title 2 . Adjudication of any infraction shall be pursuant to Chapter 18 of Title 2 .
Under D.C. Code § 42-3401.01 et seq. § 42-3405.07, the Mayor has authority to revoke a certificate, exemption, or registration related to housing conversions and sales if the holder has failed to follow a cease-and-desist order, broken a stipulation or agreement made with the Mayor, or intentionally misrepresented or concealed material facts in an application. Before revocation, the holder is entitled to notice and a hearing, and a written finding of fact must support the decision. As an alternative to revocation, the Mayor may issue a cease-and-desist order or impose civil fines, penalties, and fees under the District's administrative adjudication process.

Property owners and managers operating under a certificate, exemption, or registration governed by D.C. Code § 42-3401.01 et seq. § 42-3405.07 generally maintain compliance by honoring all terms of any agreements made with the Mayor, adhering to cease-and-desist orders, and providing accurate and complete information in all applications. Operators who are found to have violated these requirements face potential revocation of their certificate, exemption, or registration following a notice-and-hearing process. Civil fines, penalties, and fees may also be imposed as alternative sanctions under the District's administrative enforcement framework.

D.C. Code § 42-3401.01 et seq. § 42-3405.07 provides tenants with a framework of accountability for landlords who hold certificates, exemptions, or registrations related to housing conversions and sales, since those documents can be revoked if the holder misrepresents facts, breaks agreements with the Mayor, or ignores cease-and-desist orders. Tenants who believe a landlord has engaged in such conduct may consider filing a complaint with the relevant District agency or raising the violation through the administrative process described in the provision. Tenant-rights organizations in the District can help explain what documentation or steps are generally involved in pursuing such a complaint.
