D.C. Code tit. 8 § 8-241.07
Indoor Mold Assessment and Remediation Fund.
Operative Text
(a) There is established a special fund the Indoor Mold Assessment Fund, which shall be administered by the District Department of the Environment in accordance with subsection (c) of this section. (b) The Fund shall consist of the revenue from the fees collected in accordance with § 8-241.03 and any other money accepted for the benefit of the Fund. The Fund may be supplemented by other District funds at the Mayor’s discretion or by an act of the Council. (c) (1) The Fund shall be used to administer the certification and licensing programs established under § 8-241.03 and may be used to administer grants issued under paragraph (2) of this subsection. (2) Where there are funds in excess of the amount needed to administer the certification and licensing programs under § 8-241.03 , those funds shall be used to provide financial assistance grants to: (A) Low-income District residents for the purpose of having a professional mold assessment conducted in their premises, in the event that the owner of the resident’s property fails to comply with the requirements in § 8-241.04 ; and (B) Residential property owners without financial means, as determined by the Mayor, to comply with § 8-241.04 . (d) Any money remaining available in the Fund at the end of a fiscal year, as determined by the Chief Financial Officer in the fiscal year-end close, shall be transferred to the unassigned fund balance of the General Fund of the District of Columbia as part of the fiscal year-end close.
D.C. Code § 8-241.07 establishes the Indoor Mold Assessment and Remediation Fund, a special fund administered by the District Department of the Environment. The fund is primarily financed by fees collected under the mold certification and licensing program in § 8-241.03, and its core purpose is to sustain that program. When surplus funds exist beyond what the licensing program requires, the law directs that money toward financial assistance grants — one stream for low-income residents whose landlords have failed to meet mold-remediation obligations under § 8-241.04, and another for property owners who lack the financial means to comply with those same requirements. Any unspent balance at the end of a fiscal year is returned to the District's General Fund.

Under D.C. Code § 8-241.07, property owners who genuinely lack the financial means to meet the mold-remediation requirements of § 8-241.04 may be eligible for grant assistance drawn from the Indoor Mold Assessment and Remediation Fund. Compliant operators generally stay current with their obligations under § 8-241.04 and maintain documentation of remediation efforts, which positions them well regardless of fund availability. Awareness of the fund's existence and the Mayor's role in determining financial eligibility can be useful context when planning compliance budgets.

D.C. Code § 8-241.07 creates a potential financial resource for low-income District residents: when the Indoor Mold Assessment and Remediation Fund has surplus money, grants may be available to cover the cost of a professional mold assessment if a property owner has failed to comply with § 8-241.04. Tenants who believe their landlord is not meeting mold-remediation obligations may wish to contact the District Department of the Environment to learn about current grant availability and eligibility criteria. Tenant-rights organizations in the District can also help residents understand how § 8-241.04 obligations and the fund's grant program interact with other housing remedies.
