14 DCMR § 14-3907
INTERVENORS
Operative Text
3907.1 There shall be no intervenors as a matter of right in Rental Accommodations Division proceedings, but intervenors may be permitted to participate in the proceeding prior to a hearing if the proceedings will directly affect their rights or duties and is otherwise appropriate. 3907.2 A request to intervene shall be by motion stating the reasons why intervention should be permitted. 3907.3 While a proceeding is pending before the Rent Administrator, intervenors shall be considered full parties and shall have the same rights and duties as a party to a petition, with the following exceptions. (a) Intervenors shall not have an independent right to a hearing; and (b) Intervenors may participate only with respect to issues affecting them that do not require a hearing, as determined by the Rent Administrator.
Under D.C. Mun. Regs. tit. 14 et seq. § 14-3907, participation as an intervenor in Rental Accommodations Division proceedings is not guaranteed as a matter of right — it is discretionary and requires a formal motion explaining why intervention is appropriate. If permitted, an intervenor is treated as a full party while the matter is pending before the Rent Administrator, but with two key limitations: intervenors cannot independently demand a hearing, and their participation is confined to issues that affect them and do not require a hearing. The Rent Administrator determines the scope of any permitted intervention.

Property owners and managers involved in Rental Accommodations Division proceedings should be aware that under D.C. Mun. Regs. tit. 14 et seq. § 14-3907, third parties may seek to join a proceeding as intervenors by filing a motion before a hearing takes place. Compliant operators generally track whether any such motions have been filed, since an approved intervenor gains full-party status — including the ability to submit filings and respond to issues — within the limits set by the Rent Administrator. Understanding who has been permitted to intervene helps operators anticipate the scope of participation in a pending proceeding.

D.C. Mun. Regs. tit. 14 et seq. § 14-3907 establishes that tenants or other affected parties who are not original petitioners may seek to participate in a Rental Accommodations Division proceeding by filing a motion to intervene before a hearing is held. If the Rent Administrator grants the request, an intervenor is treated as a full party for most purposes, though they cannot independently trigger a hearing and may only weigh in on issues that directly affect them. Tenants who believe a pending proceeding affects their rights may wish to consult a tenant-rights organization or legal aid provider to understand whether seeking intervention status is an available path.
