Fla. Stat. § 723.001 et seq. § 723.007
Annual fees; surcharge.
Operative Text
(1) Each mobile home park owner shall pay to the division, on or before October 1 of each year, an annual fee of $4 for each mobile home lot within a mobile home park which he or she owns. If the fee is not paid by December 31, the mobile home park owner shall be assessed a penalty of 10 percent of the amount due, and he or she shall not have standing to maintain or defend any action in the courts of this state until the amount due, plus any penalty, is paid. (2) There is levied on each annual fee imposed under subsection (1) a surcharge in the amount of $1. The surcharge shall be collected in the same manner as the annual fee and shall be deposited in the Florida Mobile Home Relocation Trust Fund. Collection of the surcharge shall begin during the first calendar year after this subsection takes effect. This surcharge may not be imposed during the next calendar year if the balance in the trust fund exceeds $10 million on June 30. The surcharge shall be reinstated in the next calendar year if the balance in the trust fund is below $6 million on June 30. The surcharge imposed by this subsection may not be imposed as a separate charge regardless of any disclosure in the prospectus.
Under Fla. Stat. § 723.007, mobile home park owners in Florida are required to pay an annual fee of $4 per mobile home lot to the state division by October 1 each year, along with a $1 per-lot surcharge that is deposited into the Florida Mobile Home Relocation Trust Fund. If the fee is not paid by December 31, a 10 percent penalty is added to the outstanding amount. A park owner who fails to pay the fee and any applicable penalty loses standing to bring or defend lawsuits in Florida courts until the full balance is settled. The surcharge is subject to automatic suspension or reinstatement based on the trust fund's balance as of June 30 each year.
Plain English — not legal advice.
Operators of mobile home parks subject to Fla. Stat. § 723.007 generally submit their annual per-lot fee of $4—plus the applicable $1 surcharge—to the division on or before October 1 each year to avoid the 10 percent late penalty that attaches after December 31. Compliant operators track the trust fund balance thresholds that determine whether the surcharge applies in a given year, since the surcharge is automatically suspended when the fund exceeds $10 million and reinstated when it falls below $6 million. Importantly, § 723.007 prohibits passing the surcharge on to residents as a separate line-item charge, even if the park's prospectus contains a disclosure suggesting otherwise.

Fla. Stat. § 723.007 establishes that the annual fee and surcharge are obligations of the mobile home park owner, not the residents—and the statute explicitly prohibits the surcharge from being imposed on residents as a separate charge regardless of any prospectus language. Tenants who believe a park owner is improperly passing this surcharge through as a separate cost may have grounds to raise that as a concern with the Florida Division of Florida Condominiums, Timeshares, and Mobile Homes, or to consult a tenant-rights organization familiar with mobile home park law. Residents may also find it useful to review their prospectus and any fee disclosures in light of the protections § 723.007 provides.
