Fla. Stat. § 723.001 et seq. § 723.022
Mobile home park owner’s general obligations.
Operative Text
A mobile home park owner shall at all times: (1) Comply with the requirements of applicable building, housing, and health codes. (2) Maintain buildings and improvements in common areas in a good state of repair and maintenance and maintain the common areas in a good state of appearance, safety, and cleanliness. (3) Provide access to the common areas, including buildings and improvements thereto, at all reasonable times for the benefit of the park residents and their guests. (4) Maintain utility connections and systems for which the park owner is responsible in proper operating condition. (5) Comply with properly promulgated park rules and regulations and require other persons on the premises with his or her consent to comply therewith and conduct themselves in a manner that does not unreasonably disturb the park residents or constitute a breach of the peace.
Florida Statute § 723.022 establishes ongoing obligations that mobile home park owners must meet at all times. These obligations include complying with applicable building, housing, and health codes; keeping common areas and shared buildings in good repair, safe, clean, and visually maintained; ensuring residents and their guests can access common areas at reasonable times; maintaining utility connections and systems under the owner's responsibility in proper working order; and following park rules while requiring others on the premises to behave in ways that do not unreasonably disturb residents or breach the peace. The statute frames these as continuous duties rather than one-time requirements.
Plain English — not legal advice.
Under Fla. Stat. § 723.022, compliant mobile home park operators routinely inspect and repair common-area buildings, landscaping, and infrastructure to meet applicable code standards and maintain a safe, clean appearance. Operators also keep utility systems within their responsibility in proper working order and ensure that access to shared spaces is available to residents and guests at reasonable times. Maintaining documentation of inspections, repairs, and rule-enforcement actions is a practice commonly associated with demonstrating ongoing compliance with these obligations.

Fla. Stat. § 723.022 gives mobile home park residents a legal basis to expect that their park owner will continuously uphold standards for common areas, utilities, code compliance, and peaceful conditions on the premises. If a park owner appears to be falling short of these obligations—such as allowing common areas to fall into disrepair or failing to maintain utility systems—residents may consider documenting the conditions and exploring options such as filing a complaint with local code enforcement or housing authorities. Tenant-rights organizations familiar with Florida mobile home park law can help residents understand the range of remedies and enforcement paths available under this provision.
