Fla. Stat. § 723.001 et seq. § 723.024
Compliance by mobile home park owners and mobile home owners.
Operative Text
Notwithstanding any other provision of this chapter or of any local law, ordinance, or code: (1) If a unit of local government finds that a violation of a local code or ordinance has occurred, the unit of local government shall cite the responsible party for the violation and enforce the citation under its local code and ordinance enforcement authority. (2) A lien, penalty, fine, or other administrative or civil proceeding may not be brought against a mobile home owner or mobile home for any duty or responsibility of the mobile home park owner under s. 723.022 or against a mobile home park owner or mobile home park property for any duty or responsibility of the mobile home owner under s. 723.023.
Florida Statute § 723.024 establishes a clear division of enforcement responsibility between mobile home park owners and mobile home owners. When a local government identifies a code or ordinance violation, it must cite the party actually responsible for that violation rather than the other party. Critically, the law prohibits liens, fines, penalties, or civil proceedings from being brought against a mobile home owner or their home for violations that are the park owner's responsibility, and vice versa—each party is only exposed to enforcement actions tied to their own duties.
Plain English — not legal advice.
Under Fla. Stat. § 723.024, mobile home park owners are shielded from fines, liens, or civil proceedings that arise from duties assigned specifically to mobile home owners under § 723.023. Compliant park operators generally maintain clear documentation of which maintenance and operational responsibilities belong to the park versus the resident, making it straightforward for local code enforcement to identify the correct responsible party. Keeping records of park-side obligations and their fulfillment helps ensure that any citation issued by a local government is directed appropriately.

Fla. Stat. § 723.024 provides mobile home owners with meaningful protection: a local government cannot impose a lien, fine, penalty, or civil proceeding against a mobile home owner or their home for a violation that is actually the park owner's responsibility under § 723.022. If a tenant believes a citation or enforcement action has been misdirected to them for something that falls under the park owner's duties, they may raise this statutory protection as a defense in any resulting proceeding. Tenant-rights organizations familiar with Florida mobile home law can help residents understand how this provision applies to their circumstances.
