Fla. Stat. § 723.001 et seq. § 723.072
Affidavit of compliance with statutory requirements.
Operative Text
(1) A park owner may at any time record, in the official records of the county where a mobile home park is situated, an affidavit in which the park owner certifies that: (a) With reference to an offer by him or her for the sale of such park, he or she has complied with the provisions of s. 723.071(1); (b) With reference to an offer received by him or her for the purchase of such park, or with reference to a counteroffer which he or she intends to make, or has made, for the sale of such park, he or she has complied with the provisions of s. 723.071(2); (c) Notwithstanding his or her compliance with the provisions of either subsection (1) or subsection (2) of s. 723.071, no contract has been executed for the sale of such park between himself or herself and the park homeowners’ association; (d) The provisions of subsections (1) and (2) of s. 723.071 are inapplicable to a particular sale or transfer of such park by him or her, and compliance with such subsections is not required; or (e) A particular sale or transfer of such park is exempted from the provisions of this section and s. 723.071. Any party acquiring an interest in a mobile home park, and any and all title insurance companies and attorneys preparing, furnishing, or examining any evidence of title, have the absolute right to rely on the truth and accuracy of all statements appearing in such affidavit and are under no obligation to inquire further as to any matter or fact relating to the park owner’s compliance with the provisions of s. 723.071. (2) It is the purpose and intention of this section to preserve the marketability of title to mobile home parks, and, accordingly, the provisions of this section shall be liberally construed in order that all persons may rely on the record title to mobile home parks.
Florida Statute § 723.072 establishes a mechanism by which a mobile home park owner can record a sworn affidavit in the county's official records attesting to their compliance—or the inapplicability or exemption—of the notice and offer requirements found in § 723.071 when selling or transferring the park. Once recorded, this affidavit can be conclusively relied upon by anyone acquiring an interest in the park, as well as by title insurance companies and attorneys examining title, with no obligation to investigate further. The overarching purpose of § 723.072 is to protect the marketability of title to mobile home parks by allowing all parties to trust what appears in the public record.
Plain English — not legal advice.
Under Fla. Stat. § 723.072, park owners who have completed the homeowners' association notice and offer process required by § 723.071—or who believe those requirements do not apply or that an exemption covers their transaction—have the option to memorialize that status by recording a formal affidavit in the county's official records. A compliant operator typically ensures the affidavit accurately reflects one of the specific certifications enumerated in § 723.072(1)(a)–(e) before recording it, since the document is intended to provide clear title assurance to buyers and title professionals. Keeping documentation of the underlying § 723.071 compliance process on file alongside the affidavit is a practice commonly associated with smooth closings and reduced title-related delays.

For mobile home park residents and their associations, Fla. Stat. § 723.072 is relevant because it creates a public record—the park owner's recorded affidavit—that reflects whether the owner claims to have followed the homeowners' association notice and offer procedures of § 723.071 before selling the park. Residents or association representatives can review the county's official records to determine whether such an affidavit has been filed and what it certifies, which may be pertinent when evaluating whether the association's rights under § 723.071 were properly observed. Tenant-rights organizations familiar with Florida mobile home park law, as well as local legal aid offices, can help residents understand what options may be available if they believe the underlying § 723.071 process was not properly followed before an affidavit under § 723.072 was recorded.
