Fla. Stat. § 723.001 et seq. § 723.077
The articles of incorporation of a homeowners’ association shall provide: (1) That the association has the power to negotiate for, acquire, and operate the mobile home park on behalf of the mobile home owners. (2) For the conversion of the mobile home park once acquired to a condominium, a cooperative, or a subdivision form of ownership, or another type of ownership. Upon acquisition of the property, the association, by action of its board of directors, shall be the entity that creates a condominium, cooperative, or subdivision or offers condominium, cooperative, or subdivision units for sale or lease in the ordinary course of business or, if the homeowners choose a different form of ownership, the entity that owns the record interest in the property and that is responsible for the operation of property.

Florida Statute § 723.077 sets out what a mobile home park homeowners' association must include in its articles of incorporation. Specifically, the articles must grant the association authority to negotiate for, acquire, and operate the mobile home park on behalf of residents. Once the park is acquired, the provision also requires the articles to address how ownership can be converted — whether to a condominium, cooperative, subdivision, or another form — with the association's board of directors serving as the governing entity responsible for that transition and ongoing operation.

For Property Managers

Under Fla. Stat. § 723.077, operators and developers involved with mobile home park homeowners' associations should ensure that the association's articles of incorporation expressly include both the power to acquire and operate the park and a mechanism for ownership conversion. Compliant associations typically have their board of directors identified as the entity authorized to create or offer condominium, cooperative, or subdivision units once a park is acquired. Reviewing the articles against the specific requirements of § 723.077 before finalizing any organizational documents is a standard step for property managers and association organizers in this context.

For Tenants

Fla. Stat. § 723.077 is relevant to mobile home park residents because it establishes that their homeowners' association must be structured — at the foundational articles-of-incorporation level — with the legal capacity to acquire and operate the park on their behalf. This means residents have a basis to examine whether their association's governing documents actually reflect these required powers, particularly if a park conversion or acquisition is being discussed. Tenant-rights organizations and legal aid resources familiar with Florida mobile home park law can help residents understand whether an association's articles comply with § 723.077 and what options may be available if they do not.
