Plain English

Florida Statutes § 83.43 establishes the foundational vocabulary used throughout Florida's residential landlord-tenant law. It defines key terms such as "dwelling unit," "rent," "security deposits," "deposit money," "rental agreement," and "early termination fee," among others, so that these words carry consistent, specific meanings whenever they appear in the statute. The definitions also clarify what is and is not included in certain categories—for example, an early termination fee under § 83.43(6) does not encompass unpaid rent, damage charges, or buyout agreements.

For Property Managers

Property owners and managers operating under Florida's residential landlord-tenant framework should be familiar with the definitions set out in § 83.43, because these terms govern how obligations and rights are interpreted throughout the statute. For instance, understanding that "deposit money" under § 83.43(4) encompasses a broad range of held funds—including pet deposits and any contractually agreed deposits—helps operators apply proper handling procedures to all such funds, not just traditional security deposits. Compliant operators also recognize that a "rental agreement" under § 83.43(13) includes oral agreements of less than one year, which affects recordkeeping and disclosure practices.

For Tenants

Florida Statutes § 83.43 provides the definitions that shape every right and obligation described in Florida's residential landlord-tenant law, so understanding these terms helps tenants interpret their lease and the protections available to them. For example, knowing that "deposit money" under § 83.43(4) covers a wide range of funds held by a landlord—not just a standard security deposit—can be relevant when evaluating whether a landlord has followed proper procedures for all money collected. Tenants who believe a landlord has misapplied or mischaracterized these defined terms may find it useful to consult a tenant-rights organization or review the broader provisions of Chapter 83 for applicable remedies.
