Cal. Civ. Code § 8-2-218
Change of portion of building to new use or occupancy.
Operative Text
(a) If a portion of a building is changed to a new use or occupancy and that portion is separated from the remainder of the building with vertical or horizontal fire separations complying with applicable state or local rules, regulations, codes, or standards or with compliance alternatives, then the portion changed shall be made to comply to the applicable requirements for the new use or occupancy to the extent noted in Code Section 8-2-217. (b) If a portion of the building is changed to a new use or occupancy and that portion is not separated from the remainder of the building as noted in subsection (a) of this Code section, then the provisions of the applicable state and local rules, regulations, codes, and standards applying to each use or occupancy of the building shall apply to the entire building to the extent noted in Code Section 8-2-217; provided, however, that, if there are conflicting provisions in requirements for the various uses or occupancies, the authorized enforcement authority shall apply the strictest requirements.
O.C.G.A. § 8-2-218 governs what happens when part of a building is converted to a new use or occupancy type. If the converted portion is properly fire-separated from the rest of the building, only that portion must meet the new-use requirements (to the degree specified in § 8-2-217). If no qualifying fire separation exists, the stricter requirements for all uses present apply to the entire building, with the authorized enforcement authority resolving any conflicts by applying the most stringent standard.

Property owners and managers undertaking a partial-use conversion should be aware that O.C.G.A. § 8-2-218 creates two distinct compliance tracks depending on whether adequate fire separations are installed. Operators who install vertical or horizontal fire separations that meet applicable state or local codes generally limit their compliance obligations to the converted portion alone. Those who proceed without qualifying separations typically find that the stricter occupancy requirements extend to the whole building, which can significantly broaden the scope of required upgrades under § 8-2-217.

O.C.G.A. § 8-2-218 is relevant to tenants living in buildings where a landlord has converted part of the structure to a different use, such as adding a commercial space or changing a residential unit's classification. If the conversion was done without proper fire separations, the law requires the entire building to meet the stricter applicable standards, which can affect habitability and safety conditions for all occupants. Tenants who believe a conversion has created unsafe or non-compliant conditions may consider contacting their local building or code enforcement authority, or reaching out to a tenant-rights organization familiar with Georgia building codes.
