Cal. Civ. Code § 110-11-2-.01
Definitions
Operative Text
(1) "Commissioner" means the Commissioner of the Georgia Department of Community Affairs. (2) "Department" means the Georgia Department of Community Affairs. (3) "Private Professional provider" means a professional engineer who holds a certificate of registration issued under Chapter 15 of Title 43 or a professional architect who holds a certificate of registration issued under Chapter 4 of Title 43, who is not an employee of or otherwise affiliated with or financially interested in the person, firm, or corporation engaged in the construction project to be reviewed or inspected. (4) "Regulatory Requirements" means the requirements determined by a county or municipality to be necessary for approval of plans, permits, or applications under this chapter; provided, however, that with respect to any application, such requirements shall include the Georgia State Minimum Standard Codes most recently adopted by the Department of Community Affairs and any locally adopted ordinances and amendments to such codes; applicable zoning ordinances and conditions; design standards; and other state and local laws, regulations and ordinances applicable to the application in question. (5) "State Codes Advisory Committee" (SCAC) means the advisory committee consisting of 21 members as defined in O.C.G.A. 8-2-24.
Ga. Comp. R. & Regs. ch. 110-11-2 § 110-11-2-.01 establishes the foundational vocabulary used throughout Georgia's building and construction review regulations. It defines key terms — including who qualifies as a "Private Professional provider," what counts as "Regulatory Requirements," and what bodies like the Commissioner and the Department refer to — so that the rules governing plan approvals, permits, and inspections are applied consistently. These definitions set the interpretive framework for all subsequent provisions in the chapter.
Plain English — not legal advice.
Property owners and developers operating under Ga. Comp. R. & Regs. ch. 110-11-2 § 110-11-2-.01 should be aware that "Regulatory Requirements" encompasses not only the Georgia State Minimum Standard Codes most recently adopted by the Department of Community Affairs, but also locally adopted ordinances, zoning conditions, design standards, and other applicable state and local laws. When engaging a third-party reviewer, compliant operators typically verify that the individual qualifies as a "Private Professional provider" — meaning a licensed engineer or architect with no financial or employment ties to the construction project. Understanding these definitions helps ensure that permit applications and plan submissions align with the full scope of requirements the county or municipality will apply.

While Ga. Comp. R. & Regs. ch. 110-11-2 § 110-11-2-.01 is primarily a definitions provision aimed at construction and permitting processes, it is relevant to tenants because the "Regulatory Requirements" it defines — including state minimum building codes and local ordinances — form the baseline standards that residential construction and renovation projects must meet. Tenants who believe a property was built or modified without proper permits or code compliance may find it useful to reference these definitions when researching their rights. Tenant-rights organizations or local housing agencies can help identify whether a specific concern falls within the scope of the Georgia Department of Community Affairs' oversight.
