Cal. Civ. Code § 186-1-.09
Records, Reports
Operative Text
(1) Each person subject to the Fair Employment Practices Act of 1978, as amended, who controls an apprenticeship or other training program shall keep all records reasonably necessary to carry out the purposes of said Act including, but not limited to, a list of applicants who wish to participate in such program, including the chronological order in which such applications were received. Such records shall be furnished to the Administrator upon the Administrator's request. The Administrator may also request and receive a detailed description of the manner in which persons are selected to participate in the apprenticeship or other training program. (2) Any person subject to this article shall make and keep such records as may be reasonably necessary and relevant to the determination of whether an unlawful practice has been or is being committed, and shall make such reports therefrom as are reasonably necessary or appropriate for the enforcement of the Fair Employment Practices Act of 1978, as amended, or orders or regulations under that Act. (3) Records and reports required by the Administrator shall conform as closely as practicable to similar records and reports required by federal law and to customary recordkeeping practices.
Ga. Comp. R. & Regs. ch. 186-1 § 186-1-.09 establishes recordkeeping obligations for entities covered by Georgia's Fair Employment Practices Act of 1978. Organizations that run apprenticeship or other training programs must maintain applicant lists in chronological order and preserve any records relevant to determining whether an unlawful employment practice has occurred. These records must be made available to the Administrator upon request, and where possible, they should align with comparable federal recordkeeping requirements and standard industry practices.

Under Ga. Comp. R. & Regs. ch. 186-1 § 186-1-.09, property owners or managers who operate apprenticeship or training programs—such as maintenance technician apprenticeships—generally maintain organized applicant logs that capture the chronological order of applications received. Compliant operators also retain broader employment-related records sufficient to demonstrate that no unlawful practices have occurred, and they respond promptly when the Administrator requests records or detailed descriptions of selection procedures. Aligning internal recordkeeping systems with federal employment record standards is a common practice that helps satisfy the requirement that records conform as closely as practicable to federal counterparts.

Ga. Comp. R. & Regs. ch. 186-1 § 186-1-.09 supports fair access to training opportunities by requiring that covered entities document applicants and preserve records that could reveal whether discriminatory practices have taken place. If you believe you were improperly denied participation in an apprenticeship or training program, the existence of these mandatory records can be relevant to any complaint or inquiry filed under the Fair Employment Practices Act of 1978. Tenant-rights organizations, legal aid offices, or the Administrator's office can provide general information about how these records factor into enforcement processes.
