Hawaii Revised Statutes § 515-2 establishes the foundational vocabulary for the state's fair housing chapter by defining key terms such as "disability," "familial status," "gender identity or expression," "sexual orientation," and "steering," among others. These definitions set the boundaries of who and what is protected under Hawaii's fair housing law, and what kinds of conduct or characteristics may not be used as a basis for discrimination in housing. The definitions also clarify the scope of covered transactions, properties, and participants, including real estate brokers, salespersons, and governmental entities.
Plain English — not legal advice.
Property owners and managers operating under Hawaii's fair housing framework should be familiar with the definitions in § 515-2, as these terms govern the full scope of the chapter's protections and prohibitions. A compliant operator generally ensures that leasing, rental, and property management practices do not treat applicants or tenants differently based on any of the characteristics defined here, including familial status, disability, gender identity or expression, or sexual orientation. Understanding the definition of "steering" in § 515-2 is particularly relevant, as directing prospective tenants toward or away from properties based on protected characteristics is itself identified as a discriminatory practice.

Hawaii Revised Statutes § 515-2 defines the protected characteristics and covered transactions that form the basis of the state's fair housing protections, including disability, familial status, gender identity or expression, and sexual orientation. Tenants who believe they have been treated differently in a rental or leasing situation based on one of these defined characteristics may have grounds to raise a fair housing concern. General enforcement paths include filing a complaint with the Hawaii Civil Rights Commission, which is the "Commission" referenced throughout § 515-2 and the broader chapter, or consulting a tenant-rights organization for guidance on available options.
