Idaho Code §§ 55-2701 to 55-2720 § 55-2704
DEFINITIONS.
Operative Text
(1) "Floating home" means a floating structure which is designed and built to be used, or is modified to be used, as a stationary waterborne residential dwelling, has no mode or power of its own, is dependent for utilities upon a continuous utility linkage to a source originating on shore, and has a permanent continuous connection to a sewage system on shore. (2) "Floating home moorage marina" or "moorage" means a waterfront facility for the moorage of one (1) or more floating homes and the land and water premises on which such facility is located. (3) "Landlord" means the owner of a floating home marina and includes the agent of the landlord. (4) "Moorage site" means a part of a floating home marina located over water and designed to accommodate one (1) floating home. (5) "Resident organization" means a tenant or homeowner’s association, whether or not incorporated, the membership of which is made up of tenants of the floating home marina and/or owners of a floating home. (6) "Tenant" means any person who rents a floating home moorage site or the person’s agent of record.
Section 55-2704 of Idaho's Floating Homes Residency Act establishes the core vocabulary used throughout the chapter by defining six key terms: 'floating home,' 'floating home moorage marina,' 'landlord,' 'moorage site,' 'resident organization,' and 'tenant.' A floating home under this provision is specifically a stationary, non-self-propelled waterborne dwelling that relies on shore-based utility and sewage connections. These definitions set the boundaries for who and what is covered by the rest of the Act's protections and obligations.
Plain English — not legal advice.
Under § 55-2704, a 'landlord' is defined as the owner of a floating home marina, including any agent acting on the owner's behalf, meaning that property managers and authorized representatives carry the same legal standing as the owner in the context of this Act. Operators of waterfront facilities that accommodate one or more floating homes should be aware that their facility likely qualifies as a 'floating home moorage marina' under this definition, bringing it within the Act's scope. Compliant marina operators generally ensure that their agreements and practices align with the full set of rights and obligations the Floating Homes Residency Act imposes on landlords as defined here.

Section 55-2704 defines a 'tenant' as any person who rents a floating home moorage site, or that person's agent of record, which means renters of individual water-based sites at a qualifying marina are covered by Idaho's Floating Homes Residency Act. Tenants may also participate in or form a 'resident organization'—a tenant or homeowner's association whose membership includes marina tenants and/or floating home owners—which can serve as a collective voice in dealings with the landlord. Those who believe their situation falls under these definitions and have concerns about their rights may find it useful to consult a tenant-rights organization or review the broader provisions of Idaho Code Title 55, Chapter 27 for the protections that flow from this definitional framework.
