Under 410 IAC 38 § 410-38-5-11, the individual who signs a certificate of decontamination is required to retain specific records related to decontamination and inspection work for at least five years after the certificate is issued. These records include the certificate itself, laboratory data and reports from post-decontamination sampling, relevant laboratory records tied to the analytical method used, and field sampling logs. All of these materials must be made available upon request to the property owner, the state department, the local health department, and the Indiana Department of Health.

For Property Managers

As a property owner, 410 IAC 38 § 410-38-5-11 gives you the right to request and receive the full set of decontamination and inspection records from the person who signed the certificate of decontamination. Compliant operators typically confirm at the time of decontamination that the certifying individual understands their five-year retention obligation and knows how to respond to a records request. Keeping a copy of the certificate of decontamination in your own property files is a common practice that supports documentation of the remediation history.

For Tenants

Under 410 IAC 38 § 410-38-5-11, records related to a property's decontamination — including lab results, sampling logs, and the certificate itself — must be preserved for at least five years and made available to authorized parties upon request. If you live in or are considering a property that has undergone decontamination, you may want to know that the Indiana Department of Health is among the agencies entitled to access these records. Tenant-rights organizations or a housing attorney can help you understand what avenues exist for obtaining information about a property's decontamination history.
