Cal. Civ. Code § 410-38-5-8
Laboratory reports
Operative Text
Sec. 8. The qualified inspector shall: (1) obtain from the analytical laboratory all reports and data required by: (A) Method 8270C; or (B) the equivalent method or practice used; and (2) retain those reports as required by section 11 of this rule.
Under 410 IAC 38 § 410-38-5-8, a qualified inspector conducting environmental testing is required to collect all analytical reports and data generated by the laboratory—whether produced under Method 8270C or an equivalent approved method—and to keep those records for the retention period specified in Section 11 of the same rule. The provision establishes both a collection duty and a recordkeeping duty for the inspector. It ensures that a complete documentary trail of laboratory findings is preserved after an inspection is completed.
Plain English — not legal advice.
Property owners and managers who hire qualified inspectors for environmental assessments covered by 410 IAC 38 § 410-38-5-8 should be aware that the inspector is obligated to obtain and retain all laboratory reports and underlying data from the analytical lab. Compliant operators typically confirm with their inspector that Method 8270C or an equivalent method was used and that all resulting documentation has been secured. Maintaining clear communication with the inspector about recordkeeping obligations helps ensure the property file reflects the full scope of testing performed.

Under 410 IAC 38 § 410-38-5-8, qualified inspectors are required to obtain and retain complete laboratory reports from any environmental testing conducted at a property. Tenants who have had inspections performed at their residence may have an interest in knowing that this documentation exists and is being preserved as required by the rule. Tenant-rights organizations or a local housing authority can help residents understand how to request access to inspection records or raise concerns if documentation appears to be missing.
