Cal. Civ. Code § 410-6-6-12
Submission of construction plans
Operative Text
Sec. 12. Any person or persons planning the construction, additions to, or significant change in the construction of any mobile home community shall, before the initiation of any such construction, submit plans, drawn to scale, to the department for review and approval. These plans must be certified by a registered engineer or architect licensed to practice in the state of Indiana except, as provided in IC 25-31-1-2(h), registered land surveyors may certify those portions of plans containing only: (1) platting or subdividing of land; and (2) gravity sanitary sewers, storms sewers, and tile drains.
Under 410 IAC 6-6 § 410-6-6-12, anyone planning to build a new mobile home community in Indiana, or to add to or significantly alter an existing one, must submit scaled construction plans to the Indiana state department for review and approval before any work begins. Those plans must carry certification from a licensed Indiana engineer or architect, with a limited exception allowing a registered land surveyor to certify only the portions of plans that deal with land platting or subdividing and certain gravity-flow drainage systems. The rule establishes a pre-construction approval gate rather than a post-construction inspection requirement.
Plain English — not legal advice.
Operators and developers subject to 410 IAC 6-6 § 410-6-6-12 generally engage a licensed Indiana engineer or architect early in the project timeline so that fully certified, scaled plans can be submitted to the department well before groundbreaking. Where a project involves only land platting or gravity sanitary, storm, or tile-drain elements, a registered land surveyor may certify those specific plan sections, but the broader certification requirement still applies to all other portions. Compliant operators treat department approval as a prerequisite milestone in their project schedule, not a concurrent or post-construction step.

Residents and prospective residents of mobile home communities in Indiana benefit from 410 IAC 6-6 § 410-6-6-12 because it requires that any new community or significant construction change be reviewed and approved by the state department before work starts, using professionally certified plans. If construction appears to have proceeded without that approval, tenants may raise concerns with the Indiana State Department of Health, which administers mobile home community regulations under this rule. Tenant-rights organizations and legal aid services can help residents understand how this pre-approval requirement connects to habitability and safety standards in their community.
