Cal. Civ. Code § 910-2-2-13
Discrimination in terms and conditions for making available loans or other financial assistance
Operative Text
Sec. 13. (a) It shall be unlawful for any person or entity engaged in making a loan or other financial assistance relating to the purchase, construction, improvement, repair, or maintenance of a dwelling or which is secured by residential real estate to impose different terms or conditions for the availability of such a loan or other financial assistance because of race, color, religion, sex, handicap, familial status, or national origin. (b) Unlawful conduct under this section includes, but is not limited to, the following: (1) Using different policies, practices, or procedures in evaluating or determining creditworthiness of any person in connection with the provision of any loan or other financial assistance for a dwelling or for any loan or other financial assistance which is secured by residential real estate because of race, color, religion, sex, handicap, familial status, or national origin. (2) Determining the type of loan or other financial assistance to be provided with respect to a dwelling or fixing the amount, interest rate, duration, or other terms for a loan or other financial assistance for a dwelling or which is secured by residential real estate because of race, color, religion, sex, handicap, familial status, or national origin.
Section 910-2-2-13 of 910 IAC 2 prohibits lenders and other financial institutions from applying different terms, conditions, or evaluation standards when offering loans or financial assistance for residential property based on a borrower's race, color, religion, sex, handicap, familial status, or national origin. This covers a wide range of lending decisions, including how creditworthiness is assessed and how loan amounts, interest rates, and durations are set. The rule applies to loans used for purchasing, constructing, improving, repairing, or maintaining a dwelling, as well as loans secured by residential real estate.

Property owners and managers who facilitate or refer residents to financing options should be aware that 910 IAC 2 § 910-2-2-13 governs how lenders must treat applicants equally regardless of protected characteristics. Compliant operators working with lenders or financial partners generally ensure that any financing programs offered in connection with their properties are administered without regard to race, color, religion, sex, handicap, familial status, or national origin. Maintaining consistent, documented standards for any financial assistance programs associated with a property is a hallmark of lawful operation under this provision.

Under 910 IAC 2 § 910-2-2-13, tenants and prospective buyers have a right to be evaluated for housing-related loans and financial assistance without discrimination based on race, color, religion, sex, handicap, familial status, or national origin. If a person believes a lender applied different standards or offered less favorable loan terms because of one of these characteristics, that conduct may constitute a violation of this provision. Potential enforcement paths include filing a complaint with the Indiana Civil Rights Commission or a relevant federal agency, or consulting a tenant-rights or fair-housing organization for information about available options.
