Cal. Civ. Code § 910-2-2-8
Discrimination in the provision of brokerage services
Operative Text
Sec. 8. (a) It shall be unlawful: (1) to deny any person access to or membership or participation in any multiple-listing service, real estate brokers' organization, or other service, organization, or facility relating to the business of selling or renting dwellings; or (2) to discriminate against any person in the terms or conditions of such access, membership, or participation; because of race, color, religion, sex, handicap, familial status, or national origin. (b) Prohibited actions under this section include, but are not limited to, the following: (1) Setting different fees for access to or membership in a multiple-listing service because of race, color, religion, sex, handicap, familial status, or national origin. (2) Denying or limiting benefits accruing to members in a real estate brokers' organization because of race, color, religion, sex, handicap, familial status, or national origin. (3) Imposing different standards or criteria for membership in a real estate sales or rental organization because of race, color, religion, sex, handicap, familial status, or national origin. (4) Establishing geographic boundaries or office location or residence requirements for access to or membership or participation in any multiple-listing service, real estate brokers' organization, or other service, brokers' organization, or facility relating to the business of selling or renting a dwelling because of race, color, religion, sex, handicap, familial status, or national origin.
Indiana regulation 910 IAC 2 § 910-2-2-8 prohibits discrimination in access to real estate brokerage services and organizations based on race, color, religion, sex, handicap, familial status, or national origin. This means that multiple-listing services, real estate brokers' organizations, and similar facilities may not deny membership, impose different fees, apply unequal standards, or use geographic or location-based barriers as a pretext for excluding people on protected grounds. The rule applies broadly to any service or organization connected to the business of selling or renting dwellings.
Plain English — not legal advice.
Property managers and owners who participate in or operate through real estate brokerage organizations should be aware that 910 IAC 2 § 910-2-2-8 governs how those organizations must treat all participants. Compliant operators generally ensure that any MLS memberships, brokerage affiliations, or related services they use do not apply differential fees, standards, or geographic restrictions based on protected characteristics. Operators who rely on third-party real estate organizations to list or rent properties may want to confirm that those organizations' membership and access policies align with this provision.

Under 910 IAC 2 § 910-2-2-8, tenants and prospective renters benefit from a rule that prevents real estate brokerage networks from being used in discriminatory ways that could limit who gets access to housing listings or rental opportunities. If a person believes they were denied access to rental listings or related services because of a protected characteristic such as race, familial status, or national origin, this provision may be relevant to their situation. General enforcement paths can include filing a complaint with a fair housing agency, contacting a tenant-rights organization, or consulting with a legal aid provider familiar with Indiana fair housing law.
