Cal. Civ. Code § 910-2-2-9
Discrimination in residential real estate related transactions
Operative Text
Sec. 9. (a) This section provides ICRC's interpretation of the conduct that is unlawful housing discrimination under IC 22-9.5-5-6. (b) It shall be unlawful for any person or other entity whose business includes engaging in a residential real estate related transaction to discriminate against any person in making available such a transaction, or in the terms or conditions of such a transaction because of race, color, religion, sex, handicap, familial status, or national origin.
Section 910-2-2-9 of 910 IAC 2 establishes the Indiana Civil Rights Commission's (ICRC) interpretation of unlawful housing discrimination in residential real estate transactions under IC 22-9.5-5-6. The rule prohibits any person or business involved in residential real estate transactions—such as lending, selling, or renting—from treating people differently based on race, color, religion, sex, handicap, familial status, or national origin. This applies both to whether a transaction is made available at all and to the specific terms or conditions offered.

Under 910 IAC 2 § 910-2-2-9, operators engaged in residential real estate transactions—including rental agreements, financing arrangements, and property sales—are expected to apply consistent standards regardless of an applicant's or tenant's race, color, religion, sex, handicap, familial status, or national origin. Compliant operators typically document their screening criteria, pricing policies, and transaction terms in a uniform manner that can demonstrate equal treatment across all applicants. Maintaining clear, written policies and applying them consistently helps demonstrate adherence to the conduct standards the ICRC has outlined under this provision.

910 IAC 2 § 910-2-2-9 reflects the ICRC's interpretation that tenants and prospective tenants are protected from discriminatory treatment in any aspect of a residential real estate transaction, including rental terms, conditions, and availability, based on characteristics such as race, religion, sex, handicap, or familial status. Individuals who believe they have experienced such discrimination may consider filing a complaint with the Indiana Civil Rights Commission, which administers and enforces these protections under IC 22-9.5-5-6. Tenant-rights organizations and fair housing advocacy groups can also provide general information about available enforcement paths and options.
