Operative Text

Cal. Civ. Code § 910-2-8-1
Sec. 1. IC 22-9.5 makes it unlawful to discriminate in:
(1) the sale, rental, and financing of housing;
(2) the provision of brokerage and appraisal service;
because of race, color, religion, sex, handicap, familial status, or national origin. IC 22-9.5-5-2 makes it unlawful to make, print, or publish or cause to be made, printed, or published any notice, statement, or advertisement with respect to the sale or rental of a dwelling that indicates any preference, limitation, or discrimination because of race, color, religion, sex, handicap, familial status, or national origin or an intention to make any such preference, limitation, or discrimination. However, the prohibitions of IC 22-9.5 regarding familial status do not apply with respect to housing for older persons as defined in IC 22-9.5-3-4.

Plain English

Section 910 IAC 2 § 910-2-8-1 reflects Indiana's fair housing policy, rooted in IC 22-9.5, which prohibits discrimination in the sale, rental, and financing of housing, as well as in brokerage and appraisal services, on the basis of race, color, religion, sex, handicap, familial status, or national origin. The rule also bars any notice, statement, or advertisement related to the sale or rental of a dwelling that expresses a preference, limitation, or discriminatory intent based on those same characteristics. One notable exception exists: the familial status protections do not apply to housing communities that qualify as 'housing for older persons' under IC 22-9.5-3-4.

For Property Managers

Under 910 IAC 2 § 910-2-8-1, compliant housing operators apply consistent, non-discriminatory criteria across all aspects of renting or selling property, including how they screen applicants, set terms, and communicate availability. Advertising and written communications — including online listings — are reviewed to ensure they contain no language that signals a preference or limitation based on protected characteristics such as race, religion, sex, handicap, familial status, or national origin. Operators who manage communities intended for older persons should verify that their property meets the specific qualifications outlined in IC 22-9.5-3-4 before relying on the familial status exemption.

For Tenants

Section 910 IAC 2 § 910-2-8-1 establishes that Indiana law, through IC 22-9.5, protects renters and prospective buyers from discrimination based on race, color, religion, sex, handicap, familial status, or national origin at virtually every stage of a housing transaction. Tenants or applicants who believe they have encountered discriminatory treatment — whether in a denial, an advertisement, or the terms offered — may consider filing a complaint with a fair housing agency or consulting a tenant-rights organization familiar with IC 22-9.5. Multiple enforcement paths may be available, and documenting communications, advertisements, and interactions related to the housing transaction is generally considered useful when pursuing any of those paths.
