Cal. Civ. Code § 910-2-8-2
Purpose
Operative Text
Sec. 2. The purpose of this rule is to assist all advertising media, advertising agencies, and other persons who use advertising to make, print, or publish or cause to be made, printed, or published advertisements with respect to the sale, rental, or financing of dwellings which are in compliance with the requirements of IC 22-9.5. This rule also describes the matters the ICRC will review in evaluating compliance with IC 22-9.5 in connection with investigations of complaints alleging discriminatory housing practices involving advertising.
Section 910-2-8-2 of 910 IAC 2 establishes the purpose of Indiana's fair housing advertising rule, which is to help advertising media, agencies, and others produce housing advertisements that comply with the Indiana Fair Housing Act (IC 22-9.5). The rule also outlines the framework the Indiana Civil Rights Commission (ICRC) uses when reviewing advertising as part of investigations into complaints about discriminatory housing practices. It applies to advertisements related to the sale, rental, or financing of dwellings.

Under 910 IAC 2 § 910-2-8-2, property owners and managers who advertise dwellings for sale or rent are among the parties this rule is designed to guide toward compliance with IC 22-9.5. Compliant operators generally ensure that all advertising content — whether placed directly or through an agency — avoids language, imagery, or targeting that could signal a discriminatory preference or limitation. Because the ICRC uses this rule's framework when evaluating advertising complaints, operators typically review their ad practices against the standards described in 910 IAC 2.

Section 910-2-8-2 of 910 IAC 2 establishes that the ICRC has a defined process for reviewing housing advertisements when investigating complaints of discriminatory practices under IC 22-9.5. Tenants or prospective renters who believe a housing advertisement reflected unlawful discrimination may have grounds to file a complaint with the ICRC, which will evaluate the advertising under this rule's framework. Tenant-rights organizations in Indiana can help individuals understand what types of advertising content may constitute a fair housing violation and what complaint options are generally available.
