Cal. Civ. Code § 22-9.5-11-2
Records for appeals
Operative Text
Sec. 2. (a) The appealing party shall notify the commission in writing of the party's intent to appeal and shall request the commission to prepare a record of the commission's proceedings to be used to perfect an appeal. The record consists of the following documents used, created, or presented during the administrative proceedings: (1) A transcript of the oral testimony. (2) The exhibits admitted into evidence. (3) All notices, pleadings, exceptions, motions, requests, and other papers filed with the commission with the exception of briefs or oral arguments of law. (b) The cost of producing the record for appeal must be borne by the party bringing the appeal. The commission may require the deposit of reasonable security for the payment of the cost before producing the record.
Indiana Code § 22-9.5-11-2 governs how a record is assembled when a party appeals a decision made by the civil rights commission. The appealing party must notify the commission in writing of the intent to appeal and ask it to compile the official record, which includes oral testimony transcripts, admitted exhibits, and filed documents such as notices, pleadings, and motions—but not briefs or oral arguments on legal questions. The cost of producing that record falls on the party who initiated the appeal, and the commission may require a security deposit before it begins preparing the materials.

Under Ind. Code § 22-9.5-11-2, a property owner or manager who wishes to appeal a commission decision must take prompt written action to notify the commission and formally request preparation of the appeal record. Compliant operators account for the financial obligation that comes with an appeal, since the statute places the full cost of record production on the appealing party. Operators familiar with this provision also anticipate that the commission may require a reasonable security deposit before the record preparation begins, and they budget accordingly.

Ind. Code § 22-9.5-11-2 establishes that any party—including a tenant—who appeals a commission ruling is responsible for triggering the record-preparation process through a written notice to the commission. Tenants should be aware that this same provision makes the appealing party responsible for the costs of producing the record, which can be a meaningful financial consideration when evaluating whether to pursue an appeal. Tenant-rights organizations and legal aid offices familiar with Indiana fair housing procedures can help individuals understand what the record-assembly process involves and what options may be available regarding costs.
