Cal. Civ. Code § 22-9-7-10
Documentation from out-of-state health service provider to verify need for emotional support animal; exclusion
Operative Text
Sec. 10. (a) Except as provided in subsection (b), an individual who moves from another state may provide documentation from: (1) a physician; (2) a psychiatrist; (3) a social worker; or (4) another mental health professional; licensed in that state, so long as the individual has an ongoing treatment relationship with the health service provider. (b) This section excludes a health service provider whose sole service to the individual is to provide a verification letter in exchange for a fee.
Indiana Code § 22-9-7-10 addresses how individuals who have relocated from another state may document a need for an emotional support animal. Under this provision, documentation from an out-of-state physician, psychiatrist, social worker, or other licensed mental health professional can be accepted, provided the individual has an ongoing treatment relationship with that provider. However, the provision explicitly excludes documentation from any provider whose only involvement with the individual is issuing a verification letter in exchange for payment — commonly known as online ESA letter services.

Under Ind. Code § 22-9-7-10, operators who receive ESA accommodation requests from recently relocated tenants may accept documentation from out-of-state licensed health professionals, as long as the tenant has an ongoing treatment relationship with that provider. Compliant operators generally review whether the documentation reflects a genuine, continuing care relationship rather than a one-time letter-for-fee transaction. Documentation originating solely from a provider whose only service was issuing a paid verification letter falls outside what this section permits, and operators may treat such documentation accordingly.

Ind. Code § 22-9-7-10 recognizes that tenants who have moved to Indiana from another state may still rely on documentation from their existing out-of-state licensed healthcare or mental health provider to support an emotional support animal request. The key requirement is that the relationship with that provider be an ongoing treatment relationship, not a one-time paid letter service. Tenants who believe their valid out-of-state documentation has been improperly rejected may wish to consult a tenant-rights organization or legal aid office familiar with Indiana fair housing law for information about available options.
