Plain English

Indiana Code § 32-30-8-3 establishes who qualifies as a "tenant" for purposes of Chapter 8 of Title 32. Under this definition, a tenant is any person who leases or lives in a property. However, the definition specifically excludes individuals who own their mobile home, lease or rent a lot in a mobile home community, and also reside in that community — meaning mobile home owners on rented lots are treated differently under this chapter.

For Property Managers

Under Ind. Code § 32-30-8-3, property owners and managers should be aware that the protections and obligations established in this chapter apply to tenants as defined — those who lease or reside in a property. Operators of traditional rental units generally fall squarely within the chapter's scope when dealing with occupants who meet this definition. Landlords who also manage mobile home communities should note that residents who own their homes and rent only the lot are excluded from this definition and may be governed by separate legal frameworks.

For Tenants

Ind. Code § 32-30-8-3 defines who is considered a "tenant" under this chapter of Indiana law, which determines whether the chapter's rights and remedies apply to a given occupant. If you lease or reside in a rental property in the traditional sense, you generally fall within this definition. Those who own a mobile home and rent a lot in a mobile home community are excluded from this definition, and such residents may wish to consult a tenant-rights organization to understand which separate Indiana laws govern their situation.
